THIS SUPPLEMENT IS INTENDED FOR RESIDENTS OF NEVADA, U.S.A. WE ENCOURAGE YOU TO READ THIS SUPPLEMENT CAREFULLY AND USE IT TO MAKE INFORMED DECISIONS. BY USING OUR SERVICES, YOU AGREE TO THE TERMS OF THE PRIVACY POLICY AND THIS SUPPLEMENT, AND YOUR CONTINUED USE OF THE SERVICES CONSTITUTES YOUR ONGOING AGREEMENT TO THE PRIVACY POLICY AND THIS SUPPLEMENT.

GENERAL

This Nevada Supplement to Swordfish Privacy Policy details the right of individual residents of Nevada, U.S.A. to opt out of the sale of personal information. Swordfish (the “Swordfish”, “we,” “us,” or “our”) created this Supplement to provide notice to Nevada residents that they have this right relative to our online services (collectively, the “Services”). This Supplement is an integral part of Swordfish’s Terms of Service (“Terms”, and collectively, the “Agreement”). This Supplement is also an integral part of the Swordfish Privacy Policy linked here. It is not a standalone privacy policy. Any terms not defined in this Supplement will have the meanings ascribed to them in the Swordfish Privacy Policy.

As stated in the Privacy Policy, we collect personal information from “Contacts,” and our Services involve the sale to our customers of access to that personal information. “Contacts” are people whose identities are being confirmed, who are the subject of an investigation, or who are being contacted by Users, for example for recruitment or sales purposes. Information from Users of the Swordfish Services is also added to the Swordfish Database and therefore Users become Contacts as well.

NEVADA CONSUMER PRIVACY ACT DISCLOSURES

(i) “Covered Information” Under Nevada Law

Nevada law provides protections relating to what that state calls “Covered Information.” Business Profiles include elements of personal information considered to be “Covered Information” under Nevada law, specifically:

  • First and last names
  • Electronic mail addresses
  • Telephone numbers
  • Social media account information that identifies individual Nevada residents

(ii) The Opt-Out Right Under Nevada Law

  • (a) Our Request Address.
Nevada law requires that Swordfish, as an operator of an online service, establish a designated request address through which Nevada residents may submit opt-out requests regarding sales of Covered Information, as described in the next subsection. Swordfish has established the following designated request addresses to receive such opt-out requests:
Postal mail address: Swordfish, 1, Knighton Heath, Ringwood Road, Dorset, BH11 8NE United Kingdom
    Email address: contact@swordfishapp.com

  • (b) Disclosure Concerning Nevada’s Opt-Out Right
Operators of websites and online services doing business with Nevada residents fall under a recent Nevada privacy law that establishes an opt-out right. In specific, Nevada residents are entitled to submit a verified request directing these operators not to make any sale of any Covered Information the operator has collected or will collect about that resident. Nevada residents can submit these requests to designated request addresses established by each operator.

  • (c) Your Opt-Out Right
Accordingly, if you are a Nevada resident Contact with a Business Profile in one of our Databases, you have the right to request that Swordfish not sell any of your Covered Information that Swordfish has collected or will collect about you. Please note that by law we must be able to verify the authenticity of the request and the identity of the person making the request before we are required to act on it. Verifying requests prevents identity theft and unauthorized requests.

  • (d) Exercising Your Opt-Out Right
If you are a Nevada resident Contact and wish to submit a verified opt-out request that Swordfish not make any sale of your Covered Information, please submit a request to one of the designated request addresses listed above. When we receive a request, our privacy team will take steps to verify the authenticity of the request and the identity of the person making the request. If we can verify the request, our Services will no longer provide Users with Business Profile. If we cannot verify the request, we will inform you of the reasons for the inability to verify it.
